Terms of Service

These Terms apply to the Nomad Cairn website, iOS application, Meet Profiles, sign-in and Save continuation flows, and related services (together, the “Service”). If you do not agree to these Terms, do not use the Service. Our Privacy Policy explains how we handle personal information and is incorporated into your use of the Service.

You must be at least 18 years old and legally able to enter into these Terms. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization.

You sign in through Apple or Google. You are responsible for maintaining control of your sign-in account and device, providing accurate information, and promptly updating information that changes. You may not impersonate another person, create an account for someone else without authority, transfer your account, or use another person’s credentials.

Tell us promptly at legal@nomadcairn.com if you believe your account has been accessed without permission.

Nomad Cairn helps you remember people you have met, keep private relationship context, maintain a Meet Profile, exchange Meet Profiles, and find your way back to relevant connections. Saving a person is a one-way action. It does not create a mutual relationship or verify identity, employment, qualifications, trustworthiness, or that two people have met.

The Service is not a social feed, employment agency, marketplace, professional directory, background-check provider, or identity-verification service. It does not guarantee clients, work, introductions, matches, collaborations, or any business result.

Your Nomad Cairn Profile is public by design. Anyone with its Meet Profile URL may view the public fields you choose to provide. Search-engine instructions such as “noindex” reduce discoverability but are not access controls. Do not publish information you want to keep private.

You can edit public fields or rotate your public URL. Rotation makes the previous Nomad Cairn URL unavailable, but it cannot recall copies, screenshots, vCards, photos, contact details, or links that another person has already saved, exported, or shared outside the Service.

You may save private information about people you have met. You are responsible for having an appropriate and lawful reason to collect, upload, use, and retain that information. Keep only what is reasonably useful for your relationship context, respect requests to correct or remove information, and do not use Nomad Cairn to surveil, profile, harass, discriminate against, or harm another person.

Do not store passwords, government identifiers, financial account details, medical records, precise real-time location, intimate information, or other highly sensitive information unless you have a clear lawful basis and it is genuinely necessary. Nomad Cairn’s private technical boundary does not give you an unlimited right to collect information about others.

You retain ownership of content you submit to the Service. You give Nomad Cairn a limited, worldwide, non-exclusive license to host, store, reproduce, process, back up, and display that content only as reasonably necessary to provide, secure, maintain, and improve the Service and to comply with law.

For Meet Profile content, this license includes displaying it to anyone who visits your Meet Profile. For private relationship-record content, it is limited to operating the owner-private features and authorized support or security activity. You represent that you have the rights and permissions needed to submit your content and allow these uses.

You may not use the Service to:

• Break the law, infringe another person’s rights, or upload content you do not have permission to use.
• Harass, threaten, stalk, surveil, exploit, discriminate against, or impersonate anyone.
• Build or enrich a directory of strangers, scrape Meet Profiles, harvest contact details, or send unsolicited bulk messages.
• Probe, disrupt, overload, reverse engineer, or bypass authentication, rate limits, owner boundaries, or other security controls, except where applicable law expressly permits security research.
• Upload malware, harmful code, unlawful content, or material that exposes another person’s sensitive information.
• Use automated means to access the Service without our written permission, other than ordinary search-engine behavior that follows our published instructions.

The Service depends on or links to third parties, including Apple, Google, Supabase, Vercel, Email, Instagram, LinkedIn, and WhatsApp. Their services are governed by their own terms and privacy policies. We do not control their availability, content, security, or actions and are not responsible for them. You choose whether to open or use an external contact method.

The Service, including its software, design, branding, and original content, is owned by Nomad Cairn or its licensors and is protected by applicable intellectual-property laws. These Terms do not grant you rights to our trademarks, source code, or other property except the limited right to use the Service under these Terms.

If you provide feedback, you allow us to use it without restriction or compensation, but we do not acquire ownership of your personal content merely because you provide feedback.

We may add, change, suspend, or discontinue features. We do not promise that the Service will always be available, uninterrupted, error-free, or compatible with every device or provider. We will take reasonable care with material changes and provide notice where required. Material changes to personal-information handling are also governed by the Privacy Policy.

We may limit or suspend access when reasonably necessary to protect the Service or others, investigate misuse, comply with law, or respond to a material breach of these Terms. Where appropriate, we will try to explain the reason and give you a chance to correct the issue.

You may stop using the Service at any time. You can start account deletion from Settings in the iOS application and confirm the permanent deletion while signed in. Deletion removes or de-identifies service-controlled account data, subject to limited security, backup, legal, and dispute-resolution retention described in the Privacy Policy. It cannot recall copies another person independently saved or information sent to third-party services.

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage. We do not endorse or guarantee users, Meet Profile claims, contact information, introductions, opportunities, or third-party services.

To the fullest extent permitted by applicable law, Nomad Cairn will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, goodwill, or business interruption arising from or related to the Service. Where liability cannot be excluded, it will be limited to the minimum amount permitted by law.

These limitations do not apply where prohibited, including to liability that cannot legally be limited. Your local law may give you additional rights.

You are responsible for your use of the Service, your content, and your interactions with other people. To the extent permitted by law, you agree to reimburse reasonable losses, liabilities, and costs caused by your unlawful content, your material breach of these Terms, or your infringement of another person’s rights. This does not apply to the extent a loss was caused by Nomad Cairn or where applicable consumer law does not permit it.

If you have a concern, contact us first at legal@nomadcairn.com so we can try to resolve it. These Terms do not select a particular court, waive mandatory consumer protections, or prevent either party from using rights and remedies available under applicable law.

We may update these Terms as the Service or applicable requirements change. We will post the updated Terms with a new effective date and provide additional notice when required. If you continue using the Service after updated Terms take effect, you accept the updated Terms to the extent permitted by law.
